PURPOSE AND GENERALITIES

These General Conditions of Use, Conditions of Sale and Privacy Policy regulate the use of the website www.rosbags.com (hereinafter “the Website”), of which Rosana C. Tellez Castillo (hereinafter ROSBAGS.COM) with N.I.F 44.899.595-F and address at Calle de las Rosas, 12-3-11 in Paterna (46980-Valencia) is the owner.

Through its website, ROSBAGS.COM provides information about its products and offers the possibility of purchasing them. Due to the content and purpose of the Website, persons wishing to benefit from its services must have the status of “Client”, which is acquired by completing the registration form and following the steps that ROSBAGS.COM subsequently communicates via email. The condition of Client implies adherence to the Conditions of Use in the version published at the time of accessing the Website.

In any case, there are pages of the Website accessible to natural or legal persons who do not register or initiate a product purchase (hereinafter, “Users”). In this sense, Users who access these parts of the Website agree to be subject to the terms and conditions set out in these General Conditions, insofar as they may be applicable to them.

ROSBAGS.COM wishes to inform its Customers and Users that it is exclusively aimed at a public over 18 years of age.

That the peninsular territory in which ROSBAGS.COM accepts and distributes orders is Spain and Portugal, except for the Balearic Islands, Canary Islands, Ceuta and Melilla. However, if a user from these territories is interested in receiving any article, he/she can contact ROSBAGS.COM through the form or by sending an email to info@rosbags.com, and we will study his/her request and inform him/her about this possibility as soon as possible.

We also accept and deliver orders abroad via international shipments.

PRODUCT INFORMATION

The descriptions of the products displayed on the Website are based on photographs, and the weights, specifications, dimensions and information given are shown on www.rosbags.com as a guide only. Rosbags shows the colours of the products as close to reality as possible. However, the colour of the products displayed on screen may be subject to variations depending on your computer monitor, so we cannot guarantee that the colours displayed will be true to life.

PRICES

All the prices of the products indicated on the website include VAT and any other taxes that may apply, as well as handling and packaging. However, these prices do not include the costs corresponding to the shipping of the products, which are detailed separately and must be accepted by the Customer.

AVAILABILITY

ROSBAGS.COM informs the Customer that the number of units available is kept up to date with the stock in warehouse and availability by our suppliers. Under no circumstances will ROSBAGS.COM intentionally offer for sale more units than are available or reserved by the supplier.

ROSBAGS.COM will do its best to satisfy all its Customers in the demand for the products. However, on occasions, and due to causes that are difficult for ROSBAGS.COM to control, such as human error or incidents in the computer systems, it is possible that the quantity finally delivered by the supplier differs from the order placed by ROSBAGS.COM to satisfy the Customer’s orders.

In the event that the product is not available after the order has been placed, the Customer will be informed by email of the total or partial cancellation of the order. Partial cancellation of the order due to unavailability does not entitle the customer to cancellation of the entire order. If, as a result of this cancellation, the customer wishes to return the delivered product, he/she must follow the stipulations in the Return section.

PAYMENT

El Cliente se compromete a pagar en el momento que realiza el pedido. Al precio inicial que figure en el sitio Web para cada uno de los productos ofrecidos se le sumarán las tarifas correspondientes a los gastos de envío pertinentes en su caso. En cualquier caso, dichas tarifas serán comunicadas previamente al Cliente antes de formalizar la propia compra.

El ticket, factura o comprobante de compra que corresponde al pedido de compra estará disponible y se podrá visualizar en www.rosbags.com en la sección “Mi cuenta”, “Pedidos”.

El Cliente deberá abonar el importe correspondiente a su pedido mediante:

-Pago a través de tarjeta de crédito o de débito (Visa, Mastercard, Visa Electrón y/o otras tarjetas análogas), la tarjeta con la que se haga el pago deberá tener como entidad financiera emisora a un banco o caja de ahorros español. El pago con tarjeta se realiza a través de Paypal con sus protocolos de seguridad.

-Transferencia o ingreso a: ROSANA C. TELLEZ CASTILLO, cuenta en oficina del banco BBVA, IBAN: ES30 0182 5763 0202 0153 7452, Código BIC/SWIFT: BBVAESMMXXX

The Customer agrees to pay at the time of placing the order. The initial price shown on the website for each of the products offered will be increased by the relevant shipping costs, where applicable. In any case, these rates will be previously communicated to the Client before formalizing the purchase itself.

The receipt, invoice or proof of purchase corresponding to the purchase order will be available and can be viewed at www.rosbags.com in the section “My account”, “Orders”.

The Customer shall pay the amount corresponding to his order by means of:

-Payment by credit or debit card (Visa, Mastercard, Visa Electron and/or other similar cards), the card used for payment must be issued by a Spanish bank or savings bank. Payment by card is made through PayPal with its security protocols.

-Transfer or deposit to: ROSANA C. TELLEZ CASTILLO, account at BBVA bank office, IBAN: ES30 0182 5763 0202 0153 7452, BIC/SWIFT Code: BBVAESMMXXX.

ORDER PROCESSING

Once the order has been formalized, that is to say, with the acceptance of the Conditions of Use and the confirmation of the purchase process, ROSBAGS.COM will always send an email to the CLIENT confirming the details of the purchase made.

CANCELLATION OF ORDERS

ROSBAGS.COM will accept order cancellations when requested prior to shipment. To make a cancellation you must request it by sending an e-mail to info@rosbags.com.

COSTS, DEADLINES, PLACE OF DELIVERY, AND LOSSES.

I. Shipping costs.

The shipping costs will be calculated automatically before finalizing the purchase, and you will be informed of them, they will be calculated taking into account the weight and volume of the order.

II. Delivery of the product

ROSBAGS.COM undertakes to deliver the product in perfect condition to the address indicated by the Customer on the order form, which in any case must be within the Territory. In order to optimize delivery, we would be grateful if the Customer could indicate an address to which the order can be delivered during normal working hours.

ROSBAGS.COM shall not be liable for errors caused in delivery when the delivery address entered by the Customer in the order form does not correspond to reality or has been omitted.

ROSBAGS.COM informs the Customer that it is possible that the same order may be divided into several deliveries.

III. Delivery Deadline

Deliveries will be made by a courier company. The order placed by you in Peninsula and Portugal will be delivered within a maximum of 10 working days after we have made the order confirmation. Although the usual delivery time of ROSBAGS.COM usually ranges between 3 to 7 working days from the completion of the order.

The international shipment will be sent by courier service, so the delivery time may take between 15 and 25 days, depending on the country of reception.

These delivery times are an estimate and may therefore vary due to logistical reasons or force majeure. In the event of delays in deliveries, ROSBAGS.COM will inform its customers as soon as it becomes aware of them.

Each delivery is considered to have been made from the moment in which the transport company places the product at the disposal of the Client, which is materialized through the control system used by the transport company.

In the event of delays in the delivery of orders attributable to ROSBAGS.COM, the Customer may cancel their order in accordance with the procedure described in Section. “Return”. Delays in delivery shall not be considered to be those cases in which the order has been placed at the disposal of the Client by the transport company within the agreed period and could not be delivered for reasons attributable to the Client.

Once the order leaves our warehouse, you will be sent an e-mail notifying you that your order has been accepted and is being shipped.

For security reasons, ROSBAGS.COM will not send any orders to PO boxes, nor will it accept any orders where it is not possible to identify the recipient of the order and their address.

IV. Delivery, Non-delivery and Loss Data

If at the time of delivery, the Client is absent, the carrier will leave a receipt indicating how to proceed to arrange a new delivery. ROSBAGS.COM contracts, as part of the courier delivery service, to carry out a series of follow-up actions aimed at ensuring that the delivery takes place.

If after 7 working days after the delivery of the order has not been arranged, the Customer must contact ROSBAGS.COM. In the event that the Client does not do so, after 10 working days from the delivery of the order, it will be returned to our warehouses and the Client will be responsible for the shipping costs and the cost of returning the goods to their origin, as well as any associated management costs.

If the reason for non-delivery is that the parcel has been lost, our carrier will initiate an investigation. In these cases, the response time of our carriers usually ranges from one to three weeks.

V. Diligence in delivery

The Client must check the good condition of the package before the carrier that, on behalf of ROSBAGS.COM, delivers the requested product, indicating on the delivery note any anomaly that could be detected in the packaging. If, subsequently, once the product has been checked, the Client detects any incident such as a blow, breakage, signs of having been opened or any damage caused by the shipment, he/she undertakes to inform ROSBAGS.COM of this via email as soon as possible, within 24 hours of delivery. From that moment on, no incidents of this type will be dealt with (only the guarantee).

RETURN

I. Refund procedure

All products purchased from ROSBAGS.COM may be returned and refunded, provided that the Customer notifies ROSBAGS.COM of his/her intention to return the product(s) purchased within a maximum period of 28 calendar days from the date of delivery and that all other conditions set out in this section are met.

ROSBAGS.COM will only accept returns that meet the following requirements:

The product must be in the same condition in which it was delivered and must retain its original packaging and labelling.
The product must be sent using the same box in which it was received in order to protect the product. In the event that it cannot be sent using the box in which it was delivered, the Client must return it in a protective box so that the product arrives at ROSBAGS.COM’s warehouse with the maximum possible guarantees.
A copy of the delivery note must be included inside the package, where the returned products and the reason for the return must also be marked.
In order to make the return process easier for the Customers and to be able to follow up the return correctly, ROSBAGS.COM establishes as the only return procedure the one established by ROSBAGS.COM. If the reason for the return is attributable to: the product is defective, it is not the one you ordered, or it is not to your liking, etc., the amount of the refund will be reimbursed.

To proceed with a return, the following steps must be followed:

Inform us within 28 calendar days of receipt that the product is to be returned. The information may be sent by post to info@rosbags.com or by ordinary mail, using the form provided.

ROSBAGS.COM will inform the customer of the address to which the product should be sent.

The customer must send it by a courier company of his choice. The return must be paid for by the customer.

Inform of the courier company used, date and time of return.

II.Refunds to the CLIENT

The return of products will give rise to a refund equal to the cost of the products returned minus the cost of the return service if applicable.

Only in the event that the delivered product is defective or incorrect, ROSBAGS.COM shall also reimburse the Customer for the corresponding shipping costs.

Returns and partial cancellations will give rise to partial refunds. ROSBAGS.COM will manage the return order under the same system that was used for the payment within 3 days from the confirmation of arrival at the warehouse of the returned order. The application of the refund to the Customer’s account or card will depend on the card and the issuing institution. The application period will be up to 7 days for debit cards and up to 30 days for credit cards.

CHANGES.

Unused products will be exchanged within 28 days of receipt. In order to exchange, you must email info@rosbags.com, before returning your RosBags, to check if the desired RosBags is in stock and to provide you with the address to which you should send the item you wish to exchange.

Once we receive your item, we will process your replacement. We will then dispatch your replacement product to you within two working days. If there is any difference in price of your chosen new RosBags and/or new item, a member of our customer service team will contact you prior to dispatch to inform you if there is any difference pending payment or refund if applicable, or to inform you of stock availability. In case of an increase in the quantity of items, it will be considered as a new order.

The cost of shipping the item to be exchanged to our offices is borne by the customer and the shipping of your new item to your home and/or delivery address will be borne by RosBags. Please ensure that you obtain a certificate of posting from your local post office for tracking purposes.

**For exchanges outside the peninsula (Spain and Portugal), the cost of shipping to RosBags.com of the item being exchanged will be the responsibility of the customer, as well as the shipping of the new item. Please note that we are not responsible for items that do not reach us due to delays in their “exchange” to our offices. We recommend that overseas customers send their parcels via a traceable service and have proof of receipt.

RIGHT OF WITHDRAWAL

You may cancel your order within 28 days (being the statutory period of 14 calendar days) of purchase. You will be refunded for such RosBags products in accordance with our Returns Policy. Under no circumstances will we reimburse you for the cost of delivery.

The right of withdrawal shall apply provided that the RosBags products are returned in the same condition in which you received them, together with their complete original packaging, labels and together with any related accessories.

We will determine whether the RosBags products are in the same condition in which they were sent to you. Products that have been returned damaged, incomplete, deteriorated, used or soiled through the fault of the customer will not be refunded and will be returned to the sender and reshipped freight collect.

In order to exercise your right of withdrawal, we invite you to fill in and submit the withdrawal form online.

GUARANTEE

The product warranty is 100% and covers manufacturing defects on items purchased through the website and from authorized dealers, for 28 days following the purchase of the product. Please note that our warranty does not cover wear and tear due to normal use of the product, or improper use of the product (excess weight in the case of bags), nor does it cover accidents, spills or defects created from self-use, repairs by third parties or modification made to the product. Do not forget that our changing bags are still bags with enough space (due to their dimensions), to carry in the compartments the baby’s things and yours, in no case the bag replaces a travel bag, despite having reinforced handles to ensure the support of what can usually be carried in the aforementioned compartments.

INTELLECTUAL AND INDUSTRIAL PROPERTY

ROSBAGS.COM holds all rights over the content, design and source code of this website and, in particular, including but not limited to, the photographs, images, texts, logos, designs, trademarks, trade names and data included on the website.

Customers and Users are advised that such rights are protected by current Spanish and international legislation on intellectual and industrial property.

Likewise, and without prejudice to the foregoing, the content of this website is also considered to be a computer program and, therefore, all current Spanish and European Community legislation on the subject is also applicable to it.

The total or partial reproduction of this website, or any of its contents, is expressly prohibited without the express written permission of ROSBAGS.COM.

Likewise, the copying, reproduction, adaptation, modification, distribution, commercialization, public communication and/or any other action that involves an infringement of current Spanish and/or international regulations on intellectual and/or industrial property, as well as the use of the contents of the Website is strictly prohibited without the express prior written authorization of ROSBAGS.COM.

ROSBAGS.COM informs that it does not grant any implicit license or authorization whatsoever on the intellectual and/or industrial property rights or on any other right or property related, directly or indirectly, to the contents included in the Website.

The use of the contents of the web domain is only authorized for information and service purposes, provided that the source is cited or referred to, and the user is solely responsible for any misuse of the same.

ACCESS AND STAY ON THE WEB. OUR CONTENTS

Customers and Users are fully responsible for their conduct when accessing the information on the Website, while browsing the Website, as well as after having accessed it.

As a consequence of the foregoing, Customers and Users are solely liable to ROSBAGS.COM and third parties for:

The consequences that may arise from the use, for illicit purposes or effects or contrary to this document, of any content of the Website, whether or not produced by ROSBAGS.COM, whether or not published officially under its name.

As well as the consequences that may arise from the use contrary to the content of this document and harmful to the interests or rights of third parties, or that in any way may damage, disable or impair the Website or its services or prevent normal enjoyment by other Users.

ROSBAGS.COM reserves the right to update the contents whenever it deems appropriate, as well as to remove, limit or prevent access to them, temporarily or permanently, and to deny access to the Website to Customers and Users who misuse the contents and/or breach any of the conditions that appear in this document.

ROSBAGS.COM informs that it does not guarantee:

That access to the Website and/or linked websites is uninterrupted or error-free.

That the content or software accessed by Clients and Users through the Website or linked websites does not contain any errors, computer viruses or other elements in the content that may cause alterations in their system or in the electronic documents and files stored in their computer system or cause any other type of damage.

The use that Clients and Users may make of the information or content of this website or linked websites for their own personal purposes.

OUR RESPONSIBILITY

ROSBAGS.COM shall not be liable in any case whatsoever in the event of their occurrence:

Errors or delays in accessing the Website by the Client when entering their data in the order form, the slowness or impossibility of receipt by the recipients of the order confirmation or any anomaly that may arise when these incidents are due to problems in the Internet network, fortuitous events or force majeure and any other unforeseeable contingency beyond the good faith of ROSBAGS.COM.

Failures or incidents that may occur in communications, deletion or incomplete transmissions, so that there is no guarantee that the services of the website will be constantly operational.

Errors or damage caused to the website due to inefficient and bad faith use of the service by the Client.

Non-operability or problems with the email address provided by the Customer for the sending of the order confirmation.

In any case, ROSBAGS.COM undertakes to solve the problems that may arise and to offer all the necessary support to the Client in order to reach a rapid and satisfactory solution to the incident.

Likewise, ROSBAGS.COM has the right to carry out, during defined time intervals, promotional campaigns to promote the registration of new members in its service. ROSBAGS.COM reserves the right to modify the conditions of application of the promotions, to extend them with due notice, or to proceed to the exclusion of any of the participants of the promotion in the event of detecting any anomaly, abuse or unethical behavior in the participation of the same.

PRIVACY POLICY

In compliance with the provisions of Organic Law 15/1999, on the Protection of Personal Data, and Regulation 679/2016 we inform you that your data will be processed by RosBags #foruniquemoms, represented by Rosana Tellez Castillo, DNI 44.899.595-F and residing at Rosas, 12-3-11 in Paterna (46980-Valencia).
Clients and Users undertake to browse the website and use the content in good faith and understand the following terms and conditions on the protection of their data:

  1. The user can contact RosBags by email at info@rosbags.com.
  2. The identification data processed are the user data of the online shop, blog and suppliers, such as name, postal and e-mail address, official document number, financial and payment data. We do not process special categories of personal data.
  3. The purpose of the processing of this data provided by the user of the website is to send information from the blog and to clearly and effectively manage the purchase of the products available in the online shop, as well as the payment made to suppliers. Also, to inform in a personalized way of new products and special promotions.
  4. The user’s personal data will be kept for an indefinite period of time, unless he/she requests that they be deleted from the files created for this purpose. The user may unsubscribe at any time. Therefore, the Client is responsible for the veracity of the data and ROSBAGS.COM shall not be liable for the inaccuracy of the Clients’ personal data. In accordance with current legislation on data protection, ROSBAGS.COM has adopted the appropriate levels of security for the data provided by Customers and has also installed all the means and measures at its disposal to prevent the loss, misuse, alteration, unauthorized access and extraction of the same.

NULLITY

In the event that any provision of these Terms of Use is declared invalid, the remaining provisions shall remain in full force and effect and shall be interpreted taking into account the will of the parties and the purpose of these Terms of Use.

ROSBAGS.COM may not exercise any of the rights and powers conferred in this document, which shall not imply in any case the waiver of the same unless expressly acknowledged by ROSBAGS.COM or the statute of limitations of the corresponding action in each case.

MODIFICATION OF THE CONDITIONS OF USE

ROSBAGS.COM reserves the right to modify, at any time, the presentation and configuration of the Website, as well as these General Conditions. Therefore, ROSBAGS.COM recommends the Client to read them carefully each time he/she accesses the Website.

Customers and Users will always have these Conditions of Use in a visible place, freely accessible for any queries they may wish to make. In any case, the acceptance of the Conditions of Use will be a prior and indispensable step to the acquisition of any product available through the Website.

APPLICABLE LAW AND ARBITRATION

These Terms of Use are governed by the applicable Spanish legislation on the matter, excluding the reference rules of private international law as well as the United Nations Convention on the International Sale of Goods. To resolve any dispute or conflict arising from these Terms of Use, the parties submit to the jurisdiction of the courts of the city of Valencia, unless the law imposes another jurisdiction.
